Privacy Policy Effective Date: January 1, 2015

At Pacific Coast Producers (“PCP”, “we” or “us”), your privacy is very important to us. The purpose of this privacy policy (“Privacy Policy”) is to provide you with a description of the types of information we collect when you visit and use our Online Application system available at <https://pacificcoastproducers.com/careers/> (the “System”), and how we use that information. By accessing or using our System, you agree to the provisions of this Privacy Policy. If you do not agree to the terms of this Privacy Policy, please do not use this System.
This Privacy Policy only applies to information collected while you are on or using the System. The System or its pages may contain links to other Web sites, including sites of third parties who have a relationship with PCP. Please be aware that when you click on a link that takes you to another Web site, any information you provide, including financial information, is subject to the privacy policy of that site. PCP does not control and is not responsible for the practices of such sites.

  1. Information We Collect
    We collect and store information that you voluntarily provide to us (which for individual users of the System may include your name, job title, contact information, including address, mobile telephone number, business telephone number, fax number and e-mail address, job history and other personal information). We may also collect data related to your individual System visits and usage.
    In addition, during your visit, we may automatically collect certain aggregate information related to your System visit. Aggregate information is non-personally identifiable or anonymous information about you, including the date and time of your visit, your IP address, your computer browser information, the Internet address that you visited prior to and after reaching our site, the name of the domain and host you used to access the Internet, and the features of our System which you accessed.
  2. How We Use Information
    PCP and/or its affiliates and third party services providers may use collected information to make the System available, to improve the services and functionality available on the System, and for other business reasons (including reasons unrelated to the System). We may use such information to perform the services or in connection with the operation of the services on the System; to respond to inquiries or service requests and monitor such responses; to resolve problems; to manage and monitor our System and assess its usage; to contact you regarding your use of the System and your application status, changes to the System or services provided thereby and to otherwise operate the System; to (in our reasonable judgment) comply with any applicable law or other legal or regulatory requirements; to respond to a request or subpoena by a government, regulatory or judicial authority, where necessary in connection with a dispute, actual or potential litigation or other legal process or an internal or external audit, or where otherwise necessary to protect the interests of PCP, its affiliates, third party service providers or other participants in the System; to protect and/or defend the Terms of Use for the System, including investigation of potential violations thereof; and to supplement your personal data with third party sources for background verification. We will also use the information to evaluate your application for employment.
  3. Disclosure of Information
    We do not sell or rent personally identifiable information about you to third parties.
    We may disclose personally identifiable information about you or your Company to appropriate affiliates, agents, subcontractors, third party service providers of PCP to operate the System and/or perform services related to the System or other business purposes of PCP, and to respond to a request for service. This may include third-party service provides we use for hosting the System, designing and/or operating the System’s features and functions, tracking the System analytics, sending email communications to users of the System, or performing other administrative services. We may provide these service providers with access to user and Company information, including personal information, to carry out the services they are performing for us. These third party service providers have access to the personal information needed to perform their functions and are obligated to maintain the confidentiality and security of that personal information. In addition, while we may use third party analytics service providers to evaluate and provide us with information about the use of the System, we do not share personal information with these analytics service providers, but they may set and access their own cookies, web beacons and embedded scripts on your computer or other device, and they may otherwise collect or have access to information about you, including non-personally identifiable information.
    In addition, we may share with third parties aggregate information about the System and its users.
    In addition, we reserve the right to disclose to third parties either aggregate information or personally identifiable information about you or your Company, as required or permitted by law and when we believe that disclosure is necessary to protect our rights.
  4. Data Retention
    We will retain your information for as long as your account is active or as needed to provide you services, comply with our legal obligations, or resolve disputes.
  5. Correction of Information; Cancellation of Account
    If you would like to access the personal data we hold about you to update it, please log into the appropriate part of the System and update this data within your account. You can also contact us at the email address below to access and update the personal data we hold about you.
    You may have certain rights under applicable data protection laws which may include the right for you to receive a copy of the personal data that PCP holds about you
    In addition, you may have a right to request that personal data is corrected, blocked or deleted if the data is factually incorrect, incomplete or irrelevant for the purposes described in this Privacy Policy. For any of these requests, please contact PCP at the address set out below.
    You may withdraw your consent for the use of your personal data at any time, but if you do so, PCP may not be able to provide certain services to you, including access to part or all of the System. To cancel your account or request we no longer use your information to provide you service or as otherwise outlined herein let us know by sending an e-mail with your request and current contact information to pcphr@pcoastp.com.
  6. Security
    We are concerned about ensuring the security of your personal data. Personal data collected by our System is stored in secure operating environments that are not available to the public. Our security procedures mean that we may occasionally request proof of identity before we disclose your personal data to you. Please understand, however, that while we try our best to safeguard your personal data once we receive it, no transmission of data over the Internet or any other public network can be guaranteed to be 100% secure. Security for this System is maintained by Oracle, who also hosts the System. Oracle’s security policies are located at http://www.oracle.com/us/legal/privacy/services-privacy-policy/index.html.
    You promise to: (a) provide true, accurate, current and complete information about yourself and your Company as prompted by a System registration form, and (b) maintain and promptly update such information to keep it true, accurate, current and complete. If you provide any information that is untrue, inaccurate, not current or incomplete, or we have reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, we have the right to suspend or terminate your account and refuse any and all current or future use of the System (or any portion thereof) to you and/or your Company. You are entirely responsible for the security and confidentiality of your password and account. Furthermore, you and your Company are entirely responsible for any and all activities that occur under your account.
  7. Changes to this Privacy Policy
    PCP may at any time revise this Privacy Policy, and you are bound by such revisions and should therefore periodically revisit this page on the System for any changes to this Privacy Policy. PCP will post any changes to this Privacy Policy on the System and, if required under applicable law, will obtain your consent to the changes. If we feel it necessary to notify you of a breach of security to the System or any data collected through the System, or other material changes to this Privacy Policy, we will notify you here, by email, or by means of a notice on the System home page.
  8. Governing Law
    Your and our Company’s use of the System and the services related thereto, and the terms of this Privacy Policy are governed by the laws of the State of California.
  9. Assignment
    We may change our ownership or corporate organization while providing the System and related services. We may also sell certain assets associated with the System. As a result, please be aware that in such event we may transfer some or all of your information to any entity acquiring all or part of our assets or to another entity with which we have merged. Under such circumstances we would, to the extent possible, require the acquiring party to follow the practices described in this Privacy Policy, as it may be amended from time to time. Nevertheless, we cannot promise that an acquiring entity or the merged entity will have the same privacy practices or treat your information the same as described in this Privacy Policy.
  10. Consent to Transfer Information to the United States
    The System is operated in the United States and intended for users located in the United States. We make no representation that the System is operated in accordance with the laws or regulations of, or governed by, other nations.
    If you are located anywhere outside of the United States, please be aware that information we collect through the System will be transferred to, processed and stored in the United States, and that collection of information pursuant to this Privacy Policy shall be governed by and construed in accordance with the laws of the United States, without giving effect to any principles of conflicts of law. The data protection laws in the United States may differ from those of the country in which you are located, and your personal information may be subject to access requests from governments, courts, or law enforcement in the United States according to laws of the United States. By using the System or providing us with any information, you consent to this transfer, processing and storage of your information in the United States.
  11. Your California Privacy Rights
    California’s “Shine the Light” law, California Civil Code § 1798.83, requires certain businesses to respond to requests from California customers asking about the business’ practices related to disclosing personal information to third parties for the third parties’ direct marketing purposes. Alternatively, such businesses may have in place a policy not to disclose personal information of customers to third parties for the third parties’ direct marketing purposes if the customer has exercised an option to opt-out of such information-sharing.
    We do not disclose personal information of any customer (collected through the System) for third parties’ direct marketing purposes, and therefore the “Shine the Light” law does not apply to the System.
  12. Do Not Track
    The System does not honor or respond to do-not-track settings on your browsers and software.
